Carmel Is a Permit Town

Carmel is a city in Hamilton County with a 2020 Census population of 99,757, and it grew by about a quarter between 2010 and 2020. About three in four homes are owner-occupied, and much of Carmel is in subdivisions with an HOA.

Unlike Indianapolis and Westfield next door, Carmel requires a permit for a new fence on any lot under three acres, and it has a front-yard rule most people have not heard of: a front fence is capped at 42 inches and at least one quarter of it has to be open. That changes what works along the street, and it is the reason a fence project in Carmel starts with a permit application and a call to Building and Code rather than a trip to the lumber yard. Above the Rest Fence builds fences for homes and businesses in Carmel, and free estimates mean we walk the lot and check the city's rules first.

Front Yards: 42 Inches and One Quarter Open

Carmel caps a required front yard at 42 inches, and at least 25% of the fence must be open so it can be seen through. In practice that means a picket fence with gaps passes, and an open aluminum fence passes. A solid privacy panel does not, because it is 100% opaque, so a solid fence stays in the side and rear yards.

Along a collector or arterial street, a fence may go above 42 inches, up to 6 feet, if it is set back at least 6 feet from the property line. Ask Carmel Building and Code Services at 317-571-2444 or Carmel Planning and Zoning at 317-571-2417.

Side and Rear Yards

Side and rear yards are capped at 6 feet in a required side or rear yard. That is where a privacy fence belongs — along the back of the lot, away from the open-front rule.

The collector and arterial street exception matters here. On a busier road, a fence may go above the 42-inch front limit, up to 6 feet, if it is set back at least 6 feet from the property line. That is a specific exception, not a general rule, so confirm the street classification with the city before you plan around it.

Drainage and Utility Easements

A fence near a drainage easement must not impede the flow of stormwater. If the fence blocks the path the water takes, the city will flag it, and the fix is usually moving the fence or opening it up where the water crosses.

A fence placed in a utility easement is at the owner's risk — the owner pays for any damage and repair if the utility needs in. On a corner lot, nothing may block the vision clearance area.

Fences That Fit Carmel's Rules

The front-yard open rule points to aluminum for the street side and privacy for the back. A pool fence carries its own barrier code on top of the city's rules, and custom gates match the fence style. We also fence commercial property in Carmel under the same permit.

HOA and the Three Things Before We Dig

Much of Carmel is in subdivisions with an HOA, and HOA approval is the homeowner's to get on top of the city's permit. See the fence rules for every town we serve.

Call 811. Indiana law requires notice to Indiana 811 at least two full working days before digging.

Carmel Fence Questions

Do I need a fence permit in Carmel?

Yes. A permit is required for any new fence on a property of less than 3 acres. Ask Carmel Building and Code Services at 317-571-2444 or Carmel Planning and Zoning at 317-571-2417.

How tall can a front-yard fence be in Carmel?

Carmel caps a required front yard at 42 inches, and at least 25% of the fence must be open so it can be seen through. A picket or aluminum fence passes; a solid panel does not.

How tall can a side or rear fence be in Carmel?

Six feet in a required side or rear yard. Along a collector or arterial street, a fence may go above 42 inches, up to 6 feet, if it is set back at least 6 feet from the property line.

What does 25% open mean for a Carmel fence?

At least one quarter of the fence surface has to be open space, not picket. A picket fence with gaps and an open aluminum fence both pass. A solid privacy panel does not, so it stays in the side and rear yards.

Can I put a fence in a drainage easement in Carmel?

A fence near a drainage easement must not impede the flow of stormwater. A fence placed in a utility easement is at the owner's risk — the owner pays for any damage and repair.

What about a corner lot in Carmel?

On a corner lot, nothing may block the vision clearance area. That keeps the sight line clear at the corner, and it can limit what goes where near the intersection.

Does my Carmel HOA approve the fence?

Much of Carmel is in subdivisions with an HOA, and HOA approval is the homeowner's to get on top of the city's permit. Get the HOA's written okay before the fence goes up.
